TERMS AND CONDITIONS

By entering The Morning Show ‘Trafalgar Tours’ promotion, you are agreeing to the following terms and conditions:

1. STANDARD TERMS

1.1 Information on how to enter forms part of the terms of entry.


2. WHO CAN ENTER?

2.1 Subject to clause 2.2, entry is open to all residents of Australia, aged 18 years old and over, where the Channel Seven and affiliate broadcasting signals are received.

2.2 Employees and their immediate families of Seven Network (Operations) Limited and their associated agencies and companies are not eligible to enter.

3. HOW TO ENTER

3.1 The competition commences on Monday 25 February 2013 at 9.00am (AEDT) and concludes on Thursday 28 February 2013 at 11.00am (AEDT) (“the Competition Period”).
3.2 In order to enter, viewers must watch The Morning Show (“the Program”) on the Seven Network during the Competition Period. Each day during the Competition Period there will be a competition segment aired during the Program, in which viewers will be invited to visit The Morning Show website (www.yahoo7.com.au/morning) to enter. Viewers must answer competition question in 25 words or less, along with their full name, address (including postcode) and daytime telephone number (including STD area code).
3.3 Entries must be received by Thursday 28 February 2013 at 11.00am AEDT.
3.4 Entries are limited to one entry per person.
3.5 The entry must be:
(a) the original independent creation of the entrant; and
(b) free from any claims, including but not restricted to copyright or trademark claims, by other parties.

3.6 Entry details remain the property of the Promoter and will not be returned to the entrant. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and the winners will not be entitled to any fee for such use.

4. PRIZES

4.1 There will be a total of one (1) winner of the Promotion who will receive:
 2 x return economy airfares from winners nearest capital city to Munich, Germany with Etihad Airways – value $5,978
 A 10 day Trafalgar guided holiday ‘Imperial Europe’ for two adults (tour inclusion can be found 10 Day Trafalgar guided holiday – Imperial Europe Inclusions - http://www.trafalgar.com/aus/imperial-europe-2013) – value $4,450

4.2 Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
4.3 The winner and their travelling companion are responsible for all other expenses including airport transfers, spending money, vaccinations, all in-room charges, meals, drinks, transfers, laundry charges, activities, incidentals, gratuities, services charges, items of a personal nature, passports, visas, telephone calls, activities, travel insurance, energy surcharges and all other ancillary costs.
4.3 Travel insurance is not included in the prize and is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
4.4 A credit card imprint or cash deposit may be required from the major prize winner at check-in to the hotel for all incidental charges.
4.5 Prize is valid to 15 December 2013. Black-out dates apply in July, August, September and Australian school holidays based on state of departure.
4.6 The flight tickets are subject to space being available in S Class and travel during peak periods and embargo periods may be restricted. This includes, but is not limited to July and August, school holidays and the public holiday period.
4.7 Bookings must be made at least 90 days prior to travel.
4.8 Travel is for a period of no more than 60 days and any tickets which remain unused after the expiry date shall be deemed null and void.
4.9 Travel is valid from Sydney, Melbourne or Brisbane only to Munich return in Coral Economy Class. For residents of Western Australia, Northern Territory, Australian Capital Territory and Tasmania a connecting economy domestic airfare from the winner’s capital city to Sydney, Melbourne or Brisbane will be arranged by Trafalgar.
4.10 Prizes cannot be redeemed for cash and are not transferable or exchangeable. The travel companions nominated by the prize winner, once nominated, are not transferable.
4.11 If for any reason any of the products listed are not available (in stock), a replacement product to equal or greater value must be chosen, subject to state government legislation. Installation of any portion of the prize ancillary or additional parts not specified is at the cost of the winner.
4.12 The prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. If the prize is not utilised by 15 December 2013 it will be fortified.
4.13 The prize winners (and their nominated travel companion) must be 18 years of age or older and must provide valid identification to the Promoter and/or Sponsor.
4.14 Any changes made to the booking by the Trafalgar and Etihad Airways prize winners or their travel companions, including extending the trip, are at the winner’s expense and must be arranged by the winner.
4.15 The prize winner and their travelling companions must travel on the same flight, at the same time, must depart from the same capital city and are responsible for their own transport from their residence to their nearest capital city for flight departure to Munich, Germany with Etihad Airways (Brisbane/Melbourne/Sydney). For residents of Western Australia, Northern Territory, Australian Capital Territory and Tasmania a connecting economy domestic airfare to Sydney, Melbourne or Brisbane from the winner’s capital city will be arranged by Trafalgar.
4.16 The Promoter will not be liable for any cost arising from or otherwise related to delays or cancellations to the travel booked by the winners, either to or from the nominated capital city and their residence. All booking and costs related to obtaining, amending or otherwise concerning the travel to/from their residence and the nominated capital city are the responsibility of the winners.
4.17 If the prize winner and their travel companion live in Western Australia, Northern Territory or Tasmania then they are responsible for transport from their residence to their nearest capital city for a domestic flight departure to Sydney, Melbourne, Brisbane and onward to Munich with Etihad Airways. The winner is responsible for travel costs to and from the points of departure which may include accommodation, excess baggage over and above the approved 30kgs, meals, all taxes, levies and surcharges, and any other travel related expenses. For residents of Western Australia, Northern Territory or Tasmania baggage restrictions may apply for the domestic flight.
4.18 The Promoter will not be liable for any cost arising from or otherwise related to delays or cancellations to the connecting flight(s) booked by the winners, either to or from the nominated capital city and Tasmania. All booking and costs related to obtaining, amending or otherwise concerning the connecting flight(s) to/from Tasmania and the nominated capital city are the responsibility of the winners.
4.19 Tickets are non-transferable, non-refundable and non-redeemable for cash or other goods or services.
4.20 No Frequent Flyer points will be accrued as part of this prize.
4.21 Lounge access is not included in this prize.
4.22 The prize winner and travelling companion are responsible for ensuring that they have valid passports and applicable visas. The Promoter will not be held responsible for any loss or delay that may occur as a result of any passport or visa not being produced in time for travel. The Promoter does not accept any responsibility if the prize winner’s nominated travel companion cannot travel because of non-compliance with any passport, visa or immigration requirements.
4.23 Compliance with any health or other government requirements is the responsibility of the prize winner and their nominated travel companion.
4.24 The Promoter may require the prize winners (and their nominated travel companions where applicable) to sign a waiver of liability and indemnity in the form determined by the Promoter in its absolute discretion.
4.25 Guests will require a minimum of 6 months validity on their passport by the time they complete travel.
4.26 It is the responsibility of the winner to enquire about local issues and conditions at destinations before travel. The Promoter and Sponsor make no representation as to the safety, conditions or other issues that may exist at any destination. International advice can be obtained from various sources, including local government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade. Compliance with any health or other government requirements is the responsibility of the prize winner.
4.27 It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize Sponsor’s requirements. Unless otherwise stated in these terms and conditions, prizes cannot be transferred, altered in any way or exchanged. All non-cash prizes cannot be redeemed for cash.
4.28 In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners grant the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
4.29 The winners agree that they will not and will ensure that their companions do not sell or otherwise make available their story and/or photographs to any media or other organisation.
4.30 Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.
4.31 It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize and the prize supplier’s requirements.

5. HOW TO WIN

5.1 The winner will be the entry judged by a panel of representatives appointed by the Promoter to be the most creative and/or original from the national pool received. All entries will be judged at the Sunrise offices at 52 Martin Place, Sydney NSW on Thursday 28th February 12.00pm (AEDT). The competition is a game of skill and chance plays no part in determining the winner.
5.2 Entries will be judged by selecting the most creative and/or original from the national pool of entries.
5.3 Winners will be notified by email by Friday 8 March 2013 at 5.00pm (AEDT).
5.4 The judges’ decision is final and the Promoter will not enter into correspondence regarding the result.
5.5 Incomprehensible and illegible entries will be deemed invalid.
5.6 It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize and prize supplier’s requirements.

5.7 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter or the Sponsor, as the case may be, in their absolute discretion.

6. NO LIABILITY

6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel, modify or suspend the competition. If, due to circumstances beyond the Promoter’s control, the Promoter is unable to provide the stated prize, the Promoter reserves the right to award a substitute prize.
6.2 Neither Seven Network (Operations) Limited, nor the Sponsors and its franchisees and their associated agencies and companies will take any responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 Neither Seven Network (Operations) Limited & affiliates nor the Sponsors and its franchisees and their associated agencies and companies will be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the judging;
b) whilst undertaking any travel won on or connected with their entry into the competition; or
c) in the participation in any prize;
d) as a consequence of late, lost or misdirected mail;
e) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
f) in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion;
g) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion
6.4 The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements.
6.5 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
6.5 Seven Network (Operations) Limited and the Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.

6.6 If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition

7. PROMOTER’S DETAILS

7.1 The Promoter is Seven Network (Operations) Limited (ABN 65 052 845 262) of Level 2, 38-42 Pirrama Road, Pyrmont, NSW 2009.
7.2 The Sponsor is Trafalgar Tours (ABN 73 000 717 715) of Travel House, 35 Grafton Street, Bondi Junction NSW 2022 and Etihad Airways (ABN 401 230 78 688) of 88 Phillip Street, Sydney NSW 2000.
7.3 Seven Network Limited (ABN 65 052 845 262) and its related entities (“Seven”), is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The entrant’s personal information may be disclosed to Trafalgar Tours and Etihad Airways for this purpose. The entrant may request access to his or her personal information by writing to Privacy Officer, c/- Legal Department, Seven Network Limited, PO Box 777, Pyrmont, NSW, 2009.
