Terms and Conditions

By entering the Sunrise/The Morning Show/Weekend Sunrise ‘Accor Hotels’ Winter’ Competition (the “Competition”), you are agreeing to the following terms and conditions:

1. STANDARD TERMS

1. Information on how to enter forms part of the terms of entry.

2. WHO CAN ENTER?
1. Subject to clause 2.2, entry is open to all residents of Australia, who are 18 years of age at the time of entry, where the Channel Seven and affiliate broadcasting signals are received.

2. Employees and their immediate families of Seven Network (Operations) Limited, AAPC Limited, MNET Group Ltd and their associated agencies and companies are not eligible to enter.

3. HOW TO ENTER
1. The Competition commences on Tuesday 22 June 2010 at 6.00am (AEST) and concludes on Monday 28 June 2010 at 4.30pm (AEST) (“the Competition Period”).
2. In order to enter the Competition, viewers must watch Sunrise (“the Program”) on the Seven Network during the Competition Period. Each morning from Tuesday 22 June 2010 to Monday 28 June 2010 in Sunrise and The Morning Show and on Sunday 27 June 2010 in Weekend Sunrise, there will be a Competition segment aired during the Programs (or any replacement program broadcast in the Sunrise, The Morning Show or Weekend Sunrise timeslots).
3. In order to enter, viewers must log into the Sunrise website (www.yahoo7.com.au/sunrise) or The Morning Show website (www.yahoo7.com.au/morning) between Tuesday 22 June 2010 at 6.00am (AEST) and Monday 28 June 2010 at 4.30pm (AEST) and register the competition codeword and their entry details (name, address, telephone number) online to enter.
4. Only one entry per person per day will be accepted from entrants online. No scripting is allowed for online entries (which will be deemed invalid).
5. The time of entry for online entrants will be the time at which the completed online entry form is received by the Competition online database. Online entrants will be presented with a confirmation page once the completed email entry is submitted by the entrant.

6. Entries remain the property of the Promoter and will not be returned to the entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.

4. PRIZES

1. There will be one (1) major winner of the Competition. The major prize winner will receive six ( 6) weekend getaways at Accor Australian destinations & properties as set out below:

o Return economy flights for up to 2 adults from winner’s nearest capital city to Sydney – value $5,000

TOTAL PRIZE VALUE (PERTH) = $6,100 BAROSSA VALLEY (NOVOTEL BAROSSA VALLEY) o Return economy flights for up to 2 adults from winner’s nearest capital city to Adelaide with transfers to the Barossa Valley – value $5,000
o 2 nights of accommodation at Novotel Barossa Valley for up to 2 adults in a Deluxe King Spa Suite, including full buffet breakfast daily – value $710

o Return airport hotel transfers in Adelaide – value $250

TOTAL PRIZE VALUE (BAROSSA VALLEY) = $5,960

TOTAL VALUE OF MAJOR PRIZE = $35,988

Total Combined Prize Value is: AU$35,988 (including GST). Prize value is correct as of 14 June 2010. The winner is not entitled to receive any money from any party if there is a difference between the maximum prize value and the actual prize value at the time of the draw.

2. The winner and their travelling companions are responsible for all other expenses including but not limited to meals (unless specified), incidentals, tips, service charges, spending money, travel insurance, taxes, visas and all transfers other than those specified. Travel insurance is not included in the prize and will be the responsibility of the winner. Travel insurance is highly recommended.
3. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize Sponsor’s requirements. Unless otherwise stated in these terms and conditions, prizes cannot be transferred or exchanged and all non-cash prizes cannot be redeemed for cash
4. A prize can be transferred to a person 18 years or over at the absolute discretion of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, a prize winner cannot take any component of the Prize and he/she does not wish to transfer the prize, then the prize will be forfeited.
5. If the winner resides in one of the prize destinations, the flight component of that prize will be null & void and not redeemable for alternative flights or cash, unless the full components of the prize are transferred to another person (who resides in another state other than the prize destination), at the absolute discretion of the Promoter.
6. If a prize or receipt of it incurs a tax liability, the prize winner is liable for payment of such tax.
7. All components of the prize, including accommodation are subject to availability, based on a limited allocation of rooms and may not be available during school holidays, holiday weekends or special events. In the event that any component of a Prize is unavailable for any reason, subject to State legislation, the Promoter reserves the right to substitute that prize component with another prize of equal value and the prize winner will be notified accordingly.
8. Major prize is valid for travel for 12 months from date of draw, excluding special event periods and public holidays (eg, New Year’s Eve, Indy Gold Coast, Christmas etc.). All components of the prize/s are to be taken at the same time.
9. If the prize winner and their travelling companions are from a regional area, travel arrangements to and from their nearest capital city airport do not form part of the prize.
10. The prize winner and their travelling companions must travel on the same flight as each other to their destination and must travel together.
11. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners grant the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
12. The winners agree that they will not and will ensure that their companions do not sell or otherwise make available their story and/or photographs to any media or other organisation.
13. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner.
14. The prize cannot be altered in any way, is non refundable and cannot be redeemed for cash.
15. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
16. The Promoter accepts no responsibility for any variations in the value of the prize as quoted in the terms and conditions and the ultimate travel date.
17. Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.
18. It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize and the prize supplier’s requirements.

5. HOW TO WIN

1. There will be one (1) major winner of the Competition. Each entrant who has entered the Competition over the Competition Period and registered all details in accordance with clause 3 (“Qualifying Entrant”) will be entered into the prize draw.

2. The draw will take place at MNET Group Ltd, Level 2, 8 Leigh Street, Adelaide SA 5000 on Friday 2 July 2010 at 12.00pm (AEST).

5.2 The winners may be announced in the Programs following the prize draw (subject to programming and Executive Producer’s decision). Winner will be notified by phone call within 2 days of the draw, their name published in the Public Notes section of The Australian Newspaper on Monday 12 July 2010 and a letter advising winners of their prize will also be mailed out upon acknowledgement of the prize.

5.3 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.

5.4 It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the promoters in its absolute discretion.

5.5 Subject to State legislation an unclaimed prize draw will take place at MNET Group Ltd at Level 2, 8 Leigh Street, Adelaide SA 5000 on Monday 25 October 2010 at 10.00am (AEST) and winners will be published in the Public Notes section of The Australian newspaper on Monday 1 November 2010.

6. NO LIABILITY
1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to State Legislation.
2. Seven Network (Operations) Limited & affiliates, MNET Group Ltd, AAPC Limited and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
3. Seven Network (Operations) Limited & affiliates, MNET Group Ltd, AAPC Limited and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
1. during the draw;
2. whilst undertaking any travel won on or connected with their entry into the draw; or
3. in the participation in any prize;
4. as a consequence of late, lost or misdirected mail;
5. due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
6. in relation to failure of an entry to be received by the promoter on account of technical problems or traffic congestion;
7. arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this Promotion;
8. if any flight is cancelled or rescheduled for any reason beyond the reasonable control of the Promoter; or

9. due to circumstances outside the Promoter’s reasonable control.

6.4 The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements, subject to State legislation.

6.5 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

6.5 Seven Network (Operations) Limited and the Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.

6.6 If for any reason this Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to State legislation. 7. PROMOTER’S DETAILS
1. The Promoter is Seven Network (Operations) Limited (ABN 65 052 845 262) of 38-42 Pirrama Road, Pyrmont NSW 2009.
2. The sponsor of the Promotion is AAPC Limited (ABN 87 009 175 820) of Level 30, 123 Pitt Street, Sydney NSW 2000.
3. Entry details remain the property of the Promoter. MNET Group Ltd, on behalf of Seven Network Limited (ABN 65 052 816 789) and its related entities (“Seven”), is collecting the entrant's personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying winners). The entrant's personal information may be disclosed to MNET Group Ltd and AAPC Limited for this purpose. The entrant may request access to his or her personal information by writing to Privacy Officer, MNET Group Ltd at Level 2, 8 Leigh Street Adelaide SA 5000, or e-mailing privacy@mnetgroup.com.
