Nissan/It Takes Two Series Viewer Voting Promotion
Terms and Conditions

By entering the Nissan/ It Takes Two Viewer Voting competition, you are agreeing to the following terms and conditions:

1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.

2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia where the Channel Seven and affiliates signal is received.
2.2 Employees and their immediate families of Seven Network (Operations) Limited, Nissan Motor Co. Australia, m.Net Corporation Ltd, and their associated agencies and companies are not eligible to enter.

3. HOW TO ENTER
3.1 The competition commences on Tuesday 12 February, 2008 at the end of the first episode of It Takes Two (“The Program”) (approximately 21:25 AEDT, subject to variation in episode time and day) and concludes on Tuesday 22 April, 2008 at the beginning of the final episode of the Program (approximately 19:30 AEST, subject to variation in episode time and day) (“the Competition Period”).
3.2 In order to enter, viewers must watch the Program on the Seven Network and Affiliates during the Competition Period. Each week viewers will be asked to vote for their favourite celebrity in accordance with the “The It Takes Two” Voting Terms and Conditions which will be available on the Seven Network’s website and which will govern the rules of voting on the Program. Voting as part of the Program will entitle viewers to enter this Competition i.e. each valid celebrity vote made while voting lines are open will also constitute an entry into the Competition. Viewers can enter the competition by:
a) Sending an SMS containing their name, State and the name of their favourite celebrity on the Program (“Favourite Celebrity”) (first name only) to the mobile telephone number 19 19 77 while voting lines are open;
Or
b) Calling and leaving their name, state and daytime contact telephone number on one of the following numbers corresponding to their Favourite Celebrity while voting lines are open:

3.3 Entrants (including the winner) in the competition may enter as many times as they like. Entries via the internet or computer generation are invalid and will not be accepted.
3.4 Entrants may enter at any time during the Competition Period up until Tuesday 22 April, 2008 at 19:30 AEST while voting lines are open. Note that voting lines will be closed during the broadcast of each episode of the Program. Lines will close at the beginning of each episode of the Program, and re-open again at the end of the episode. The opening and closing of the voting lines may vary slightly depending on the Program broadcast times each week, which will be at the discretion of the Program producers but which will be clearly communicated in the Program. The time of entry will in each case be the time the SMS message or call is received by the m.Net Corporation database.
3.5 For viewers in all states the maximum entry costs are $0.55 (including GST). SMS entries are charged at premium rate. Call costs to 1902-numbers will be higher from mobile phones.
3.6 Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

4. PRIZES
4.1 There will be one (1) major winner of the prize, as set out below.

Total prize value is $40,116.00 AUD. Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is received.
4.3 In accepting the prize, the winner agrees to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winner agrees to grant the Promoter a perpetual and exclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use.
4.4 Insurance, additional options and all ancillary costs are the responsibility of the prize winner. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the prize winner.
4.5 If the winner of the prizes is under the age of 18 and/or does not hold a current Australian driver’s licence as at the date of delivery of the car, the car will be transferred into the name of an adult or guardian nominated by the winner.
4.6 The prize cannot be transferred, exchanged or redeemed for cash.
4.7 The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements. The Promoter may at its discretion provide notice of any changes in the competition spots aired during the competition.
4.8 The winner should seek independent financial advice as tax implications may arise from the prize winnings.

5. HOW TO WIN
5.1 There will be one (1) winner drawn from the national pool of entrants. All entrants who have entered the competition and validly registered their contact details in accordance with these Terms and Conditions (“Qualifying Entrant”) will be entered into the draw. The draw will take place at m.Net Corporation Ltd at Level 2, 8 Leigh St, Adelaide SA, 5000, on Tuesday 22 April, 2008 at 19:35 AEST. One Qualifying Entrant will be drawn at random from the national pool to become the winner.
5.2 The winner will be notified by a phone call within two (2) days of the draw, and a letter advising winners of their prize will also be posted. The winner’s name will be announced in program on Tuesday 22 April, 2008 (subject to variation in episode time/date and Producer’s discretion). The winner will be published in the Public Notices section of The Australian newspaper on Monday 28 April 2008.
5.3 The promoter’s decision is final and the promoter will not enter into correspondence regarding the result.
5.4 It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements.
5.5 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
5.6 Subject to any written directions given under regulation 37 of the Lottery and Gaming Regulation 1993 (SA), an unclaimed prize draw will take place at m.Net Corporation Ltd at Level 2, 8 Leigh St, Adelaide SA, 5000, on Friday 22 August, 2008 at 10:00 AEST and the winner will be published in the Public Notices section of The Australian newspaper on Monday 1 September, 2008.

6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under the Lottery and Gaming Regulation 1993 (SA).
6.2 Seven Network (Operations) Limited & affiliates, m.Net Corporation Ltd, Nissan Motor Co. Australia, and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 Seven Network (Operations) Limited & affiliates, m.Net Corporation Ltd , Nissan Motor Co. Australia and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the draw;
b) whilst undertaking any travel won on or connected with their entry into the draw; or
c) in the participation in any prize;
d) as a consequence of late, lost or misdirected mail;
e) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
a) in relation to failure of an SMS entry message to be received by the promoter on account of technical problems or traffic congestion;
b) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion.
6.4 Entries via internet or computer generation will be deemed invalid and will not be accepted by the promoter.
6.5 Seven Network (Operations) Limited & affiliates, m.Net Corporation Ltd and Nissan Motor Co. Australia assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.
6.6 If for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition subject to government legislation.

7.2 The sponsor is Nissan Motor Co. Australia, (ABN 54 004 663 156) of 260 Frankston Dandenong Road, Dandenong South, VIC 3175.
7.3 Entry details remain the property of the Promoter. m.Net Corporation Pty Ltd , on behalf of Seven Network Limited (ABN 65 052 845 262) and its related entities (“Seven”), is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and, if you consent, for the purpose of Seven sending you promotional and direct marketing material in relation to Seven’s programs and products and services available through Seven and its business partners. The entrant's personal information may be disclosed to m.Net Corporation for this purpose.
