PROMOTER’S DETAILS

The Promoter is: Endemol Southern Star Pty Limited, Level 10, 8 West Street North Sydney NSW 2060 ACN: 003 198 838. ABN: 77 003 198 838. Authorised under NSW permit no: LTPS/09/07624, VIC permit no: 09/2610, ACT permit no: TP 09/03196, SA permit no: T09/1949.

1. Instructions on how to enter and prizes form part of these Terms and Conditions. The purpose of the competition is to give viewers a chance to win cash prizes instantly during each nightly episode of DEAL OR NO DEAL (the “Program”) broadcast on the Seven Network and affiliates during the promotional period of Monday 7th September 2009 at 17:30 (AEST) to Friday 30th October 2009 at 23:59 (AEDT).

2. Maximum entry cost is 55 cents including GST for each entry. Higher rates apply to calls to the 1902 number from mobile phones.

WHO CAN ENTER?

3. The competition is open to residents of Australia only where the Channel Seven broadcasting signal is received. Employees of the Promoter, Seven Network (Operations) Limited, Beinteractive Pty Ltd and their immediate families and agencies associated with this promotion are ineligible to enter.

GENERAL TERMS

4. The competition commences on Monday 7th September 2009 at 17:30 (AEST) and concludes on Friday 30th October 2009 at 23:59 (AEDT). However, the eligibility period will be weekdays only from Mondays @ 17:30 to Fridays @ 23:59.

5. Entrants in the competition may enter as many times as they like.

6. There will be a total of 8 weeks of Stash of Cash in which entrants will be eligible to win cash prizes instantly. Each week will offer 26 prizes (1 per case) awarded randomly throughout the week.

8. Entries must be received by 23.59 (AEST/AEDT) as per the schedule in Table A above to be eligible. The date and time of entry will in each case be the time the 1902 telephone call/SMS message is received by the Beinteractive Pty Ltd database.

9. Entries which are inaudible, incomplete or incomprehensible entries will not be eligible to be included in any draw. The Entrant is responsible for ensuring that they dial or SMS the correct promotional number to enter. In the event of an error, neither the Promoter nor Beinteractive Pty Ltd accepts responsibility for either costs incurred, entries received or any other consequences.

HOW TO PLAY

10. Entries are by telephone using the telephone promotion number 1902 555 653 (the “1902 number”) or via or by text/SMS message to 199 777 72 (the “SMS number”).

11. To enter by telephone, Entrants must call the 1902 number and enter the number corresponding to their chosen case. Entrants will also be required to leave their full name, suburb, state and daytime telephone number (“Contact Details”). 12. To enter by text/SMS message, Entrants must send a text/SMS message that includes the number corresponding to their chosen case, their full name, suburb, state and daytime contact number to the SMS number. SMS entrants will receive a reply message. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.

13. If an Entrant’s Contact Details change during the promotional period, it is the Entrant's responsibility to notify the Promoter.

14. Winners agree to participate in and co-operate in such publicity and promotional activities as reasonably requested by the Promoter. The Promoter may record and reproduce on film, tape, photograph and by other means Winners’ names, likeness, voice and appearance (“Recording”) and use the Recording (in whole or in part) in any way without further consent or cost, including the right to synchronise the audio from the recording with other visual images and the vision with other audio and may use the Winners’ name, photograph, voice and biographical material in connection with publicity and advertising for the Program and related corporate promotions.

PRIZES

15. Prizes and values are as follows: 208 x Instant winner cash prizes will be available to random valid entrants throughout the promotional period as outlined in the table below. Participants will be notified during their telephone call or reply SMS if they are an instant winner and what prize they have won. Awarding of instant winner prizes are subject to verification of eligibility including providing complete and valid entry details. Instant winners will be issued a 6 digit unique Prize Claim Number as determined by the Be.interactive Pty Ltd Instant Win system. The unique 6 digit Prize Claim Number will need to be recorded by the participant for prize verification purposes. In the event of any dispute with the Promoter, or at the Prompter’s request, Instant Winners will be required to correctly quote their unique Prize Claim Number to be awarded their prize. The Promoter reserves the right to withhold the awarding of an instant prize to a participant who cannot provide a valid, unique Prize Claim Number. Any unclaimed or un-verified prizes will be awarded during the second chance draw. Entrants who are not instant winners will be notified that they have been automatically entered into the unclaimed prize draw.

16. Each week the following 26 x Instant win prizes will be available:

The weekly prize pool is valued at $8400.

17. 1 x Major winner will be awarded $50,000 in cash.

18. All prize money will be paid to winners in the form of a cheque or by means of electronic funds transfer to an account nominated by the prize winner.

19. At the conclusion of the promotional period, all entries will be entered into the Major draw to be drawn at Beinteractive Pty Ltd, Level 9, 155 George Street, Sydney NSW 2000 on Monday 2nd November 2009 at 10:00 AEDT. Draws will also be conducted at this time to draw any un-won prizes (if applicable).

20. The total prize value is $ 117,200.

21. In the event that for any reason whatsoever a winner declines to accept the prize or any element of the prize when it is available then the prize or that element of the prize will be forfeited by the Winner.

22. If the winner is under the age of 18 years the prize will be awarded to their parent or legal guardian.

23. Instant win game materials will be void if stolen, forged, mutilated or tampered with in any way.

24. Programming and other quality control errors will not invalidate an otherwise valid prize claim.

25. Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.

26. Printing errors or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.

27. Prizes are not transferable or exchangeable. All prize values are in Australian dollars. The Promoter’s decision is final and no correspondence will be entered into.

28. Prize winners are advised to seek independent financial advice in respect of any tax implications that may arise from their prize winnings relating to the acceptance of the prize.

29. If the prize is unavailable for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal value subject to State Regulation. 30. The Winners will be notified via telephone and in writing. Winner of prizes valued over $250 will be published in the Public Notices section of The Australian Newspaper on 2nd October 2009 for Week 1 - 3, on 26th October 2009 for Week 4 – 6 and on 9th November for Week 7 – 8 and the major winner.

31. Subject to any written direction given under the relevant state regulation, an unclaimed prize draw will take place at Beinteractive Pty Ltd, Level 9, 155 George Street, Sydney NSW 2000 on 12th February 2010 at 10:00 AEDT and winners of prizes valued over $250 will have their details published in the Public Notices section of the Australian on 19th February 2010.

32. The Promoter reserves the right to request winners to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.

NO LIABILITY

33. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under the relevant state regulation..

34. The Promoter, Seven Network (Operations) Limited & affiliates, Beinteractive Pty Ltd and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

35. The Promoter, Seven Network (Operations) Limited & affiliates, Beinteractive Pty Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss or claim that may occur (except for any liability which cannot be excluded by law): a) during the conduct of this promotion; b) whilst undertaking any travel won on or connected with their entry into the draw; or c) in the participation in any prize; d) as a consequence of late, lost or misdirected mail or telephone malfunction; e) Due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other Entrants or any other person. f) arising from or related to any problem or technical malfunction of any telephone network or lines related to or resulting from participation in this promotion.

36. The Promoter, Seven Network (Operations) Limited assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.

37. Subject to state regulation, if for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.

38. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any other prize/s

39. The Promoter does not warrant or represent that the Home Viewer will win any particular amount of prize money or other prize. 40. Entry details remain the property of the Promoter. Beinteractive Pty Ltd, on behalf of the Promoter and its related entities, collects personal information of Entrants for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). Entrant’s personal information may be disclosed to State and Territory Lottery departments and winners names published as required under the relevant lottery legislation, The entrant may request access to his or her personal information by writing to Privacy Officer, Beinteractive Pty Ltd, Level 9, 155 George Street, Sydney NSW 2000.
